Russian opposition leaders detained in Moscow

MOSCOW (AP) ? Moscow police on Saturday briefly detained several opposition leaders as well as a dozen other activists while they were protesting against the intensifying crackdown on Russian opposition.

Hundreds of people gathered Saturday afternoon outside the headquarters of Russian security agency FSB, a successor to the KGB, and the office of the Investigative Committee ?sometimes called the Russian FBI ? to protest the crackdown on the opposition as well as the treatment of leftist activist Leonid Razvozzhayev.

Investigators earlier this week said that Razvozzhayev had turned himself in and confessed to plotting riots. But days later, he disavowed his confession and filed a complaint over what he said was his abduction from Ukraine. Rights activists who visited Razvozzhayev in jail say he had been tortured into confessing.

Anti-corruption campaigner Alexei Navalny as well as leftist firebrand Sergei Udaltsov and liberal Ilya Yashin were detained while they were standing in the vicinity of the FSB headquarters with posters saying "I'm against torture and repression". They were released several hours later after they were charged with staging an unsanctioned protest, which carries a fine.

Several dozen activists stood alone at various points along the route between the FSB building and the Investigative Committee headquarters, holding signs in "one-man pickets," the only legally allowed form of protest without prior approval. A few of them were detained outside the police station where the three men were kept while calling for their release.

Navalny said he thought the charges against him were fabricated and expected protesters who witnessed his arrest to support his account in court.

Elsewhere in Moscow, the owner of the Brooklyn Nets professional basketball team and former Russian presidential candidate, Mikhail Prokhorov, announced that he's leaving business to focus full-time on politics, returning to the political arena after remaining silent through a five-month Kremlin crackdown on the opposition.

Prokhorov told reporters after the conference that he wants to lead "a third power" in the country, competing both with the Kremlin and the opposition.

The 47-year-old Prokhorov, who is believed to be worth about $13 billion, finished third in Russia's presidential election in March amid speculation that his candidacy was orchestrated by the Kremlin. Though he denied the claim, he was nowhere to be seen as the government launched a crackdown on the opposition this spring, arresting activists and introducing new harsh legislation.

Prokhorov appeared Saturday at the first conference of the party he set up several months ago, announcing that he would put his money in a trust fund and let his partners at the investment vehicle Onexim manage it.

Accused UBS London "rogue trader" to begin defense

LONDON (Reuters) - British prosecutors wrapped up their case against former UBS trader Kweku Adoboli on Thursday, opening the way for him to open his defense against charges of fraud and false accounting for trades that cost the Swiss bank $2.3 billion.

After listening quietly from the back of a London courtroom for six weeks as one after another of his former UBS colleagues took the witness stand, Adoboli was expected to begin giving evidence later on Thursday.

Prosecutors closed their case by reading out an email exchange from 2008 between Adoboli and one of his friends in which they discussed a 4.9 billion euro ($7.1 billion) loss incurred by France's Societe Generale that was blamed on trader Jerome Kerviel.

Sarah Moore told Adoboli she was struck by the similarities between his and Kerviel's activities.

"Please don't let me read about you in the papers in the same fashion," she wrote. "It would destroy my faith in human nature forever."

The 11 jurors had yet to hear the voice of the 32-year-old British-educated Ghanaian, who used to work as a senior trader on the Exchange Traded Funds (ETFs) desk.

Adoboli was arrested at UBS's London offices in the middle of the night on September 15, 2011, hours after he sent an email to a back-office accountant explaining that he had booked fictitious trades to conceal losses made on "off-book" trades.

He has pleaded not guilty to two charges of fraud by abuse of position and two of false accounting. The charges cover two periods, from October 2008 to the end of May 2011, and from May 31 to September 15, 2011.

Under British law, the prosecution must prove not only that Adoboli's actions amounted to fraud and false accounting but also that his intentions were dishonest.

Adoboli's evidence was set to begin with questions from his own counsel, followed by cross-examination by the prosecution.

Lawyers estimated that his testimony could last three days, although previous time estimates given in the trial have turned out to be short of the mark.

UBS STANDARDS SCRUTINISED

Prosecutors have portrayed Adoboli as a greedy, out-of-control rogue trader who recklessly gambled away UBS's money because he wanted to be a star of the trading floor and earn bigger bonuses.

They have described a "pyramid of fraud" in which he routinely exceeded his risk limits, concealed his positions by booking fictitious hedges and lied to the back office when asked about his trades.

In their cross-examination of the prosecution witnesses, the defense team have sought to show that others within UBS knew of and condoned some of Adoboli's methods, particularly his so-called "umbrella".

This was an accounting mechanism he used to keep some of the profits from his unauthorized trades out of the desk's profit and loss accounts, and then to drip-feed them back into the accounts to smooth out fluctuations.

They have also tried to demonstrate that supervision of the ETF desk was inadequate, risk management systems were sloppy, back-office staff complacent and chains of command unclear.

The defense have suggested that Adoboli was acting for the good of the bank, in line with management calls for greater risk-taking in pursuit of greater profits.

They have said that, if Adoboli's trades had resulted in profits rather than losses, he would not have got in trouble.

The long-running trial has been a public relations headache for UBS, which has had to remain silent while Adoboli's defense team have spent weeks highlighting evidence that they say reflects poorly on the bank's standards and practices.

The bank is not a party to the case, which means that under Britain's strict laws against prejudicing trials it is not allowed to comment publicly on evidence heard in court.

After Adoboli's evidence will come closing speeches from the prosecution and from the defense, then the judge's summing-up. Then the jury will retire to consider their verdict.

In his first meeting with the media in London since his team played there three years ago, Belichick displayed his usual bad ventriloquist routine, saying as little as possible behind a mouth that was barely moving.

Two teenage brothers, Justin,15, and Dante, 17,? Robinson, have been charged with allegedly murdering of 12-year-old, Autumn Pasquale, who disappeared while riding her BMX bike. After a 48-hour search for Autumn Pasquale, investigators found her body stuffed into a recycling bin behind a vacant house next to the one where the boys lived with their family. These sociopaths beat her, strangled her and stuffed her into the bin like a piece of garbage. This was someone?s little girl.

A tip from the boys? mother is what led police to the little girl?s body. She contacted the authorities when she was alarmed by one of the boy?s Facebook postings. It?s not been released what exactly the post was but it must have been outrageous to cause a mother to turn her own children in. Can you imagine how hard that must have been?

When crime scene investigators went through the family?s home, they found Autumn Pasquale ?s BMX bike, her backpack and other belongings.

Several people in Autumn Pasquale?s small hometown of Clayton, New Jersey said they saw both boys at the vigil held Monday night for Autumn. They had the balls to stand among her friends and family and al the people who were praying for her safe return, all the while knowing that she was never coming home because she was dead. Autumn was in the recycling bin, because those little sick fucks put her there.

Justin Robinson lured her to their house with the promise of trading BMX parts, where Justin and Dante Robinson strangled a little girl for her bike, stole her from all the people who loved her and then they tossed her out trash.

Both boys turned themselves in Tuesday and have been charged with first-degree murder, conspiracy to commit murder, disposing of a body, tampering with evidence and theft. The younger boy is also charged with luring.

The brothers, who are 15 and 17, are charged as juveniles. But Prosecutor Sean Dalton said it?s likely he?ll ask that their case be moved to adult court.

As the mother of little girls, I can?t imagine what her parents are going through. I?d imagine they are beside themselves with grief and anger. The mother of the boys, my heart breaks for her because it could not have been an easy choice to turn her sons in but she did what was right. This case has left two families broken and one little girl dead.

These boys are monsters and need to be locked away from society. They are obviously dangerous if they can be so cold and commit such a heinous crime at such a young age with no remorse and have the gall to not only throw Autumn Pasquale in the garbage but to attend her vigil and look her parents in the eyes knowing what they did. They are deviants. A throat punch is too good for these boys.

My heart goes out to their mother and the parents of Autumn Pasquale.

Obama says debate prep going great, works on being aggressive

WILLIAMSBURG, Virginia (Reuters) - President Barack Obama said on Sunday his debate preparation was "going great" and aides said the Democrat would be more aggressive in his next face off with Mitt Romney after their last encounter gave the Republican challenger a boost.

Since that first debate in Denver on October 3, polls indicate Romney has erased Obama's lead heading into the November 6 election. Obama and Romney debate again on Tuesday at Hofstra University in Hempstead, New York. The third and final presidential debate will take place on October 22 in Florida.

Obama is spending the days ahead of the second debate at a resort in Williamsburg, Virginia, a battleground state that both candidates want to win in order to be victorious on November 6.

During a quick stop at a local campaign office, where he delivered pizzas to volunteers and called supporters by phone, Obama had an enthusiastic take on his practice sessions.

"It is going great," Obama told reporters.

Before his debate in Denver, Obama held a similar "debate camp" in the swing state of Nevada. During a visit to a campaign office there, he called the practice sessions "a drag."

That attitude may have shown through on stage. His performance was widely panned as passive, and Romney's energetic showing gave his campaign a significant lift.

"The president is his own harshest critic and he knows Mitt Romney had a better night at the first debate," campaign spokeswoman Jen Psaki said on Sunday.

"The American people should expect to see a much more energized President Obama making a passionate case for why he is a better choice for the middle class."

Obama started debate preparation around 10 a.m. on Sunday before breaking for the campaign office stop. He joked with volunteers that he was able to use the traditional landline phones because he had them at home.

"We actually still have old style phones...at the White House," he said.

SHOWDOWN

On Sunday's talk shows, Obama's advisers said he was preparing for a stepped-up performance, but the Romney team sounded unimpressed.

"Well, the president can change his style. He can change his tactics. He can't change his record. And he can't change his policies. And that's what this election is about," Romney campaign adviser Ed Gillespie told CNN.

"I think the race is very close. I think the wind is at Governor Romney's back, and there's clearly momentum. You can see it on the trail, you can see it in the data," Gillespie said in a separate appearance on "Fox News Sunday."

In contrast to Obama's listless debate performance, Vice President Joe Biden was far more assertive in his debate on Thursday night with Romney's running mate Paul Ryan in Danville, Kentucky.

The next presidential debate is a "town hall" format, allowing audience members to pose questions. CNN anchor Candy Crowley will moderate the debate.

Former White House communications director Anita Dunn, a longtime Obama adviser, was playing the role of Crowley in the president's mock sessions, a campaign aide said.

Obama's chief campaign strategist David Axelrod told the "Fox News Sunday" program the president would be aggressive in making his case on Tuesday.

"But the other thing he's going to certainly do - I mean, we saw Governor Romney sort of serially walk away from his own proposals - certainly the president is going to be willing to challenge him on it as we saw the vice president challenge Paul Ryan," Axelrod said.

Report: Military recruiters shot paintballs at homeless

Military recruiters with the Arizona Army National Guard engaged in a pattern of systemic misbehavior over the past decade that included instances of sexual abuse, forgery, embezzlement and assaults, including riding in a Humvee and shooting paintball guns at homeless people, according to a five-month investigation by The Arizona Republic newspaper.

The newspaper cites interviews with military officers, police reports and military documents obtained through public records requests.?


The alleged wrongdoing was primarily carried out by a small group of military recruiters assigned to visit high schools as part of efforts to enlist them in the armed forces, according to the newspaper.

National Guard investigators said commanders failed to hold subordinates accountable for wrongdoing, partly because they also allegedly engaged in unethical behavior.

In response to the investigation, Arizona Gov. Jan Brewer announced an inquiry into Arizona?s military operations by a National Guard officer of another state.

"Gov. Brewer has called for a full, fair and independent review of the Arizona National Guard, its personnel and policies, and the discipline that has been handed down for the recent instances of misconduct that have been documented,"?Matthew Benson, a spokesman for Brewer, told NBC News.

Benson said Brewer was in the process of identifying the appropriate outside party to carry out the review.

"She would like the inquiry to begin as quickly as possible so that she is provided credible information with which to judge the conduct of the Arizona National Guard and its leaders," Benson said in a statement.

The highest-ranking officer at Arizona National Guard, Maj. Gen. Hugo Salazar, acknowledged discipline problems and failures by commanders.

"I acknowledge there was a problem," Salazar, told the Republic, "We should have had more command emphasis. We should have paid more attention.? Salazar said he did not think there is an ongoing problem.

Military documents detail that non-commissioned officers caught driving drunk in military vehicles were dealt with lightly, and recruiters who forged records or took fraudulent bonus paychecks only received transfers, the Republic reports.

In addition, sergeants who had affairs with teenage recruits were given counseling. One staff sergeant, the paper reported,?allegedly had sex with a female enlistee but was still allowed to deploy overseas. While overseas, he was disciplined for similar offenses, and was transferred to the California National Guard as a recruiter, according to the report.

On Monday, the newspaper reported that Staff Sgt. Chad Wille, a recruiter who blew the whistle about the alleged misconduct, had been harassed afterward.

A bicyclist had reported incidents of a camouflage-painted Humvee driving down Seventh Street in north Phoenix shooting paintballs at pedestrians. When Wille questioned a colleague, Sgt. 1st?Class Michael Amerson, about it, Amerson reportedly replied, ?You?re not aware of the bum hunts??

Further investigations would unearth more allegations of sexual misconduct, including offering homeless women food, money or drinks for exposing their breasts.

FREE IS MY LIFE: MOVIE REVIEW: Here Comes the Boom

This movie review for "Here Comes the Boom" was written by guest blogger Liz Parker...

Kevin James is back on the big screen in Here Comes the Boom, which is suspiciously similar to 2011's Warrior except that in this case, the main character is trying to raise money for a school music program rather than needing money for himself and his family. Boom is also a comedy, whereas Warrior was a drama. I originally wrote Boom off in my mind, thinking it was going to be a silly movie about MMA (mixed martial arts), but it actually had a few funny moments and ended up exceeding my expectations.

Scott Voss (James) once loved teaching, but now is a slacker: he shows up late, gets docked vacation days, and doesn't care about his class. His friend Marty (Henry Winkler) is the orchestra teacher at the school, and one day Scott comes across them practicing and is impressed by how good they sound. When the school principal (Greg Germann) announces budget freezes and says that the music program will be cut, Scott realizes that Marty might lose his job, and decides that he will work together with the other teachers to raise the $47,000 or so needed to keep the program. This is easier said than done, though, especially because most of the teachers, with the exception of Bella (Salma Hayek), don't really care about putting in the extra time to save the orchestra. Scott used to wrestle in college, and after his friend Niko (Bas Rutten) tells him how much MMA fighters make, even for losing a match, he hatches a crazy scheme to enter the ring and raise the money for the music program. Scott doesn't anticipate how hard it will be, though, and gets thrown around in the arenas more than a few times before hitting his stride.

The ending of the film was predictable but some of the jokes throughout it were amusing. Kevin James actually lost more than 80 pounds to play the part, and supposedly did about 70-80% of the stunt work in the ring himself, too. He has good chemistry with Salma Hayek, and Henry Winkler has a part in the film too, as both the orchestra teacher and his moral support while fighting, though sometimes his character disappeared for long stretches of time.

Yes, see this film. I'd say overall I would give it 3 out of 5 stars, but the MMA fights make the film exciting and interesting to watch, so that increased it another half-star, in my opinion. This movie was definitely better than James's last film, Zookeeper, and James's comedy kept the audience laughing throughout its runtime. You don't have to know much about MMA fighting either to enjoy the film, as James's character definitely didn't at the beginning of it, and with a PG-13 rating it will appeal to almost all audiences.

Here Comes the Boom is in theaters now and is rated PG-13 with a runtime of 104 minutes. 3.5 stars out of 5.

Andes survivors mark 40th anniversary of crash

SANTIAGO, Chile (AP) ? Surviving members of an Uruguayan rugby team have played a match postponed four decades ago when their plane crashed in the Andes, stranding them for 72 days in the cordillera and forcing them to eat human flesh to stay alive.

The Old Christians Club squared off Saturday in Santiago in a game that was tied 1-1 against the Old Grangonian Club, the former Chilean rugby team they were supposed to play back when their flight went down. Their terrifying story became the basis of a best-selling book and a Hollywood movie.

"At about this time we were falling in the Andes. Today, we're here to win a game," crash survivor Pedro Algorta, 61, said as he prepared to walk onto the playing field surrounded by the jagged mountains that trapped the group.

During the anniversary ceremony, military jets flew over the field, where parachutists draped in Chilean and Uruguayan flags landed. In a corner, survivors wept when officials unveiled a commemorative frame with pictures of those who died in the snowy peaks.

"The conditions were more horrifying than you can ever imagine. To live at 4,000 meters without any food," said survivor Eduardo Strauch, 65. "The only reason why we're here alive today is because we had the goal of returning home ... (Our loved ones) gave us life. They made the sacrifice for others."

The Uruguayan air force plane that carried the team crashed in a mountain pass in October 1972 while en route from Montevideo to Santiago. Of the 45 passengers aboard, 16 survived by feeding on dead family members and friends preserved in the snow.

"I think the greatest sadness I felt in my life was when I had to eat a dead body," said Roberto Canessa, 59, who was a teenage medical student at the time of the crash.

"I would ask myself: Is it worth doing this? And it was because it was in order to live and preserve life, which is exactly what I would have liked for myself if it had been my body that lay on the floor," he said

Desperate after more than two months in the frigid peaks, Canessa and Fernando Parrado left the crash site to seek help. It was the group's last attempt at survival.

After 10 days of trekking, they spotted Sergio Catalan, a livestock herder in the foothills of the Chilean Andes. The conditions were such that the pair couldn't get too close to Catalan, but from afar, they heard him say one word: "Tomorrow."

"With that (word), our suffering ended," Canessa said.

Catalan, who at the time rode his horse to the nearest town to alert rescuers, returned to meet the survivors on Saturday in a hat and poncho. He walked slowly this time with the aid of a cane and pointed at the sky when helicopters hovered over the field just as they did 40 years ago over the barren mountains.

Carlos Paez, 58, waved a small red shoe at a helicopter carrying Parrado as he did when the Chilean air force choppers rescued him and the others. Parrado gave a similar red shoe to his friends at the crash site before he left for the cordillera and guided rescuers back.

"I came back to life after having died," said Parrado, whose mom and sister died in the Andes. "It's something that very few people experience." His experience, he said scarred him but made him stronger and brought him a newfound appreciation for life.

"Since then, I have enjoyed fully, carefully but without fear. I tried to enjoy my friend, my dog, my passions, a second at a time," said Parrado, who has been a TV host, a race car driver and a motivational speaker.

Survivor Daniel Fernandez, 66, held the trophy that would have been the reward for the game to be played the day of the crash.

The ordeal "taught me that we set our own limits," Fernandez said. "If I had been told: 'I'm going to leave you in a mountain 4,000 meters high, 20 degrees Celsius below zero (-4 Fahrenheit ) in shirtsleeves, I would have said: I last 10 minutes.' Instead, I lasted 72 days."

French president commits to exchange in Congo

KINSHASA, Congo (AP) ? French President Francois Hollande said his country was committed to facilitating freedom of movement, exchange and trade within the French-speaking world during a Saturday visit to Congo for the Francophonie Summit.

A celebration of the French language, the summit serves as an occasion for leaders of French-speaking countries and others to meet and discuss pressing political issues.

"The French language must carry democracy, human rights, pluralism, the respect of freedom of expression, every human being must be able to choose his leaders, those are the principles that francophones must carry," Hollande said.

Organized for the first time in a Central African country, this year's summit is taking place in the Congolese capital but the botched presidential and legislative elections of November 2011 have jeopardized its organization.

Hollande hinted at irregularities that marked the re-election of Congo President Joseph Kabila. The French president initially threatened not to attend the summit but ultimately confirmed his participation in July, saying he wants to break away from the traditional paternalistic ways of France toward Africa, a theme he embraced in his speech Saturday.

"I wanted to come to Kinshasa to express again my faith in Africa's future," he said.

Hollande's first trip to Africa since his elections as France's head of state in May has generated a lot of debate around France's role in Africa and it has been portrayed as an opportunity for the French president to break away from his predecessors' attitude towards Africa.

On Friday, Hollande made a stop in the former French colony of Senegal, where ex-President Nicolas Sarkozy gave a speech five years ago that was viewed as deeply insulting to Africans whom he said had "not yet entered into history."

"I want to declare here my willingness to renew the relationship between France and Africa. The era of Franceafrique is over. There is now a France and there is an Africa. And there is a partnership between France and Africa, based on relationships that are founded on respect," he said.

Hollande said he wanted to remove barriers to allow for stronger exchanges and freedom of movement within the French-speaking world by facilitating visas acquisition, boosting aid to development and trade and campaigning for the creation of a global organization for the environment based in Africa.

Crisis resolution should be part of the new francophone deal too, he said.

The Energi plug-in hybrid would accompany the standard C-Max hybrid onto lots at the end of this year.

The original plan was for the Ford CMax Energi to beat the Toyota Prius and achieve more than the 95 MPG EPA rating the Japanese hybrid delivers. We?re sure Ford would also like to have beaten the 98 MPG rating of the Chevrolet Volt too.

Well it has, officially, the Ford CMax Energi has been rated at 100 MPGe. That?s the most fuel economy of any hybrid so far and probably more than Ford were hoping for. The results of this test also means the Ford C-Max Energi gets an entire new EPA category for plus 100 MPGe vehicles.

The next stumbling block Ford has to overcome is that of range. Estimates so far give a 20 mile range in electric-only. That also exceeds the Prius? 6 miles electric-only range, but is so far only an estimate.

Range is still the major limiting factor in all electric vehicles. While fuel-electric hybrids can overcome the limits, doing so impacts that gas mileage. With the plug-in electric capability of the Ford C-Max Energi, running costs are going to be kept to a minimum.

With an estimated price of around $33,000 and a release date of early next year, the Ford C-Max Energi is destined for good things. We?re betting it will sell well in California if nowhere else. Gas prices hit $5 per gallon there last week!

Nobel week?a fine time to celebrate science?s most notable achievements. As you raise your glass to this year?s laureates, why not toast one of chemistry?s most delectable discoveries. Because it?s the 100th anniversary of the Maillard reaction, without which toast would be just a boring piece of dry bread.?

As noted in the current issue of Chemical & Engineering News [Sarah Everts, The Maillard Reaction Turns 100], in 1912 Louis-Camille Maillard first described what happens when you cook sugars along with protein. Driven by the heat, these molecules react to produce a variety of savory smells and tastes, the good stuff in everything from grilled steak and French fries to dark roast coffee, maple syrup, and crusty bread.

The reaction takes place pretty much any time you cook, which makes it the most favored?and flavored?chemistry around.

Of course, the Maillard reaction is not all peaches and cream?or popcorn and caramel. The same chemistry can also create acrylamide, a potential carcinogen made when meat gets charred on the barbie. And so chemists continue to work adding flavor to foods while keeping them carcinogen-free. Now that?s a recipe that should win a ticket to Stockholm.

(AP) ? Justin Bieber says some of his belongings were stolen during a show in Washington state.

The pop star tweeted to his nearly 29 million followers that he and his tour manager were victimized during the show Tuesday night at the Tacoma Dome. He didn't lay out exactly what was stolen, but referenced a computer and a camera. He said what bothers him the most is that he had a lot of "personal footage" on them.

He adds that "people should respect other's property."

A Tacoma police spokesman says officers are not investigating because no police report has been filed.

Verizon Wireless told NBC News Wednesday?that's not completely accurate.?

"Our customers can change their privacy preferences at any time," said a company spokeswoman. "The 30-day window is essentially the initial time frame so customers can read and look at their options, but again, they can change them any time through MyVerizon."

The carrier also wants customers to know that "there are several different programs" it uses for information sharing, if allowed by the subscriber, including a recent program called Precision Market Insights, announced by Verizon Oct. 1.

"Information for Precision is anonymous and aggregated, and not personally identifiable," the Verizon spokeswoman said. "Customers can opt out at any time."

A quick check of my own privacy settings with Verizon for a smartphone and a mobile hot spot (below)?showed I was letting them collect information, including location-based services info, because I had not chosen to opt out by selecting "Don't Share My CPNI" (Customer Proprietary Network Information):

"CPNI is not new," said the Verizon Wireless spokeswoman. "There are FCC rules about it (and we comply)."

Indeed, the statement by Verizon under CPNI says:

As a provider of certain telecommunications services, Verizon Wireless collects certain information that is made available to us solely by virtue of our relationship with you, such as quantity, technical configuration, type, destination, location and amount of use of the telecommunications services you purchase. This information and related billing information is known as Customer Proprietary Network Information (CPNI). The Federal Communications Commission and other regulators require the Verizon Companies to protect your CPNI.

Still, customers need to take the trouble to?find their way to opt out of sharing information. In the case of Verizon Wireless, go to?Verizon Wireless online and sign into your account. Scroll down to "I want to?..." and beneath those words you'll see options for "bill" "plan" "device" "profile." Under "profile," choose "Manage privacy settings." That's where you'll find the above check boxes to change. (Be sure to hit "Save changes" when you're done.)

"Sadly, it's just?another case of companies failing to respect the preferences of users in?an effort to undermine their privacy and monetize their data," Parker Higgins of the Electronic Frontier Foundation told NBC News. "While it's?a minor reassurance that this data appears to be anonymized and?aggregated, these companies still ought to get a meaningful opt-in from?their users."

Verizon Wireless is not alone in data collection, of course. NBC News contacted the other major carriers to find out how they handle it.

A?Sprint spokeswoman told NBC News that "much like programs of other carriers," its "research and analytics program combines anonymous Mobile Usage Information and Consumer Information to prepare business and marketing reports that we may share with others.

"We may produce or allow others to produce limited business and marketing reports with this data. Business and marketing reports contain information about groups or categories of Sprint customers.??These reports do not identify customers personally."

Customers, she said, can opt out "at any time" by signing into their Sprint account online and going to "My Choices," or by calling 855-596-2397 from their mobile devices.?

Updated?at 5:50 p.m. Wednesday: AT&T and T-Mobile, in statements to NBC News, said they?have policies similar to Verizon Wireless and Sprint: So again,?you must choose to opt out of data collection.

"Customer privacy is of the utmost importance to AT&T," said spokesman Mark A. Siegel. "That is why we provide our customers a variety of privacy options through our website, giving them the ability to exercise those options any time."

A T-Mobile spokesman referred us?to the company's website about customer privacy information, which says, in part, "We may obtain your consent in several ways, such as in writing; online, through 'click-through' agreements; orally, including through interactive voice response; or when your consent is part of this policy or the terms and conditions pursuant to which we provide you service. Your consent is sometimes implicit."

Supreme Court justices challenge affirmative action at universities

WASHINGTON (Reuters) - Supreme Court justices on Wednesday vigorously challenged a University of Texas admissions program that favors some African-American and Hispanic applicants in a case that could determine how universities use affirmative action at campuses nationwide.

The legal battle is the most closely watched case of the court's current term, striking at the heart of two defining American characteristics - race and opportunity. The country's racial makeup has also changed significantly over time, with racial and ethnic minorities making up more than half of the children born in the United States for the first time this year, according to government data.

The University of Texas and its supporters contend that universities must have the flexibility to consider race to ensure diversity. Opponents say it is time to eliminate racial preferences, which they say are unconstitutional.

In Wednesday's arguments, members of the court's conservative wing pressed a lawyer for the university on the goals of affirmative action and whether universities would ever be able to stop using race in their admissions decisions.

Some of the liberal justices suggested the court should not overturn its prior rulings.

Justice Sonia Sotomayor summed up the central issue facing the court: "When do we stop deferring to the university's judgment that (considering) race is still necessary?" she asked. "That's the bottom line of this case."

The case involves Abigail Fisher, a white student who was denied admission by the University of Texas at Austin in 2008. Fisher sued the same year, claiming that racial minorities with worse credentials were accepted ahead of her. She argued that the school's use of race in admissions violated the U.S. Constitution's guarantee of equal protection. The university countered that it needed the flexibility to consider race as one of many factors to build a "critical mass" of underrepresented minorities.

'WHERE IS THE END POINT?'

Chief Justice John Roberts pressed university lawyer Gregory Garre on how judges would know when UT had achieved its desired level of diversity: "When will I know that you've reached a critical mass?"

Garre responded that critical mass is not a certain number but rather a point where "African Americans and Hispanics do not feel like spokespersons for their race." At that moment the university would stop using race in admissions, he said.

But Fisher's lawyer, Bert Rein, reiterated the Chief Justice's concern: "Where is the end point? If you have nothing to gauge the success of the program ... there is no judicial supervision."

Questions from liberal justices Ruth Bader Ginsburg, Sonia Sotomayor and Stephen Breyer implied support for the program. Breyer questioned Rein why the court should backtrack on past decisions that have allowed affirmative action.

Breyer asked Rein why the court should overturn a precedent into which "so much thought and effort went" and which "so many people across the country have depended on."

The overall tone of the hearing suggested that while the court might not uphold the Texas plan, there would not be a majority of justices to broadly strike down the use of race in admissions.

The justices who appeared most resistant to the Texas plan were Roberts and Justices Samuel Alito and Antonin Scalia. Justice Clarence Thomas, who asked no questions, would likely side with those conservatives based on his past writings on affirmative action.

Justice Anthony Kennedy, whose position may be decisive, signaled some concerns with the Texas plan but did not indicate by his questions that he was ready to curtail such nationwide practices.

NINE YEARS OF RELIANCE

The case arises nine years after the Supreme Court narrowly upheld affirmative action in a dispute over the University of Michigan Law School's admissions practices. By a 5-4 vote the court in 2003 said universities could consider an applicant's race alongside a host of other factors to improve diversity.

Public universities in 43 states that allow affirmative action and thousands of private colleges and universities have relied on that decision, Grutter v. Bollinger, to include race in their admissions decisions.

The Texas case has drawn more than 90 friend-of-the-court briefs from scores of academic institutions, think tanks and public interest groups, most in support of Texas.

The court's Public Information Office said people began lining up for spectator seats from 6 p.m. on Tuesday and waited overnight. More than 80 reporters had sought seats.

The court has changed since 2003. Justice Sandra Day O'Connor, who wrote the University of Michigan decision, retired in 2006 and has been replaced by the more conservative Alito. O'Connor watched the arguments in the courtroom on Wednesday.

SECURING RACIAL DIVERSITY ON CAMPUS

The University of Texas fills most of its entering class of freshmen using a policy that grants automatic admission to in-state students in the top 10 percent of their high school class. For the remaining slots it considers an applicant's race as one of many factors to improve diversity.

Fisher's claim rests on the legal argument that, under the Equal Protection Clause, universities can use race only if there is no other way to improve diversity. Fisher argues that the top 10 percent law is sufficient for boosting racial diversity.

The 5th U.S. Circuit Court of Appeals rejected her challenge, based on the Supreme Court's 2003 ruling.

Some of the justices suggested that because Texas considers an applicant's race for only part of its student body, the Texas program would easily pass the standard set forth in the 2003 case. Ginsburg described the University of Texas' use of race as "more modest" than the admissions policy in the Michigan case.

"If it's so few, then what's the problem?" asked Kennedy, referring to the number of slots the school fills using the race-conscious admissions policy.

But the fact that the gains from the race-based part of the process are so small, compared with the top 10 percent plan, could lead the court to conclude that the university does not need to rely on race at all.

Alito asked Garre how the university's use of race could "possibly do more than a tiny, tiny amount to increase classroom diversity."

The hundreds of demonstrators who gathered outside the courthouse on Wednesday overwhelmingly favored keeping the university policy intact. They carried signs saying: "Diversity works," "Out of many, one America" and "Expand Opportunity."

Cortney Sanders, a third-year student at the University of Texas and an African American, said: "The University of Texas used to be a school of exclusion, now it is promoting a policy of inclusion ... We are many people, but we are one America."

Only eight justices heard the oral arguments. Justice Elena Kagan, an Obama appointee who would be expected to endorse affirmative action, did not participate. Although she did not specify why she recused herself, she could well have worked on the case in her previous job as U.S. solicitor general.

A 4-4 tie would affirm the lower court decision in favor of Texas. If a majority rejects the Texas program, the overriding question is how broadly it will rule. It could reject only the Texas program or rule that universities can no longer consider race in choosing their students.

The court is expected to issue a decision before the term ends in June.

The case is Fisher v. Texas, U.S. Supreme Court, No. 11-345.

Beverage company Dr Pepper Snapple Group (DPS) recently announced that from 2013 onward its consumers can get calorie information when they purchase from its vending machines in Chicago and San Antonio. The installation of the vending machines, which will display calorie count, is a part of the Calorie Count Vending Program. Following its launch in these two cities, the program will eventually be extended to different parts of the nation. Previously, the companies had to provide calorie labels on every beverage product, so that the consumers could make a well-informed choice.

Dr Pepper Snapple Group offers several options in low calorie drinks, like Diet Dr Pepper and Diet Snapple brands. Its latest product innovation includes Dr Pepper TEN, which contains only 10 calories per serving.

Low calorie products have a huge demand in the market with the growing number of health conscious consumers. Given the rise in lifestyle diseases, people are more concerned about the nutritional value of packaged food. Introduction of calorie count vending machines will allow consumers to make a conscious dietary choice, as they can enjoy the beverages and at the same time be aware of the number of calories consumed.

Most food and beverage companies acknowledge that they need to increase the health quotient of their products in order to accommodate the consumer shift toward healthier lifestyle. One of Dr Pepper?s peers, The Coca-Cola Company (KO) is also installing calorie count vending machines in Chicago and San Antonio.

US releases estimate of Utica Shale reserves

Drilling companies beginning to explore the Utica Shale got a piece of good news Friday when the U.S. Geological Survey estimated the rock formation in Ohio, Pennsylvania and other states holds enormous reserves of natural gas and oil.

Releasing its first estimate of the Utica, the USGS calculated the shale formation holds about 38 trillion cubic feet of undiscovered, recoverable natural gas, 940 million barrels of oil and 9 million barrels of natural gas liquids like ethane and propane.

The Utica lies beneath the Marcellus Shale, where energy companies have drilled thousands of unconventional gas wells in Pennsylvania in recent years. The Marcellus is considered to be one of the richest natural gas reserves in the world.

Drillers are just beginning to tap into the deeper Utica. Pennsylvania and Ohio have issued 452 Utica well permits to date, and 178 wells have been drilled, according to the most recent state data.

The geological survey's Utica estimate covered parts of Maryland, New York, Ohio, Pennsylvania, Virginia and West Virginia.

Such estimates are highly variable and subject to revision. The USGS estimated last year that the eight-state Marcellus region contains some 84 trillion cubic feet of undiscovered, recoverable natural gas, far more than its 2002 assessment of just 2 trillion.

"As more (Utica) wells are drilled and more production data is assessed, reserves figures will likely increase," said Steve Forde, vice president of the Marcellus Shale Coalition, a drilling industry trade group. He hailed the Utica as "another game-changing opportunity."

Domestic production of shale gas has soared in recent years as drillers perfected a technique called hydraulic fracturing, or fracking, and combined it with horizontal drilling to reach previously inaccessible reserves deep underground. The production boom has resulted in lower prices for consumers while stoking concerns about water and air pollution. The drilling industry says its practices are safe.

ATLANTA ? The pharmacy that distributed a steroid linked to an outbreak of fungal meningitis has issued a voluntary recall of all of its products, calling the move a precautionary measure.

The New England Compounding Center announced the recall Saturday. The company said in a news release that the move was taken out of an abundance of caution because of the risk of contamination. It says there is no indication that any other products have been contaminated.

The Food and Drug Administration had previously told health professionals not to use any products distributed by the center.

The Centers for Disease Control and Prevention posted updated figures to its website Sunday showing there are 91 confirmed cases of the rare form of fungal meningitis. The outbreak spans nine states and has killed at least seven people.

The states with reported cases are: Florida, Indiana, Maryland, Michigan, Minnesota, North Carolina, Ohio, Tennessee and Virginia.

The steroid linked to the outbreak had already been recalled, and health officials have been scrambling to notify anyone who may have received an injection of it. The Massachusetts pharmacy that made it has said it is cooperating with investigators.

It is not yet known exactly how many people may have been affected, though it could affect hundreds or even thousands of people who received the steroid injections for back pain from July to September.

Meningitis is caused by the inflammation of protective membranes covering the brain and spinal cord. Fungal meningitis is not contagious as are its more common viral and bacterial counterparts.
